earAccess® and ACCESS® hearing aids

ACCESS hearing aids are a product brand of earAccess® Inc., 239 Notre-Dame St. W, Suite 402, Montreal, QC, H2Y 1T4, Canada. The website earaccess.com is operated by earAccess® Inc.

Distribution of these products in the Philippines is handled by earAccess® Philippines Inc. and IMT FINE Marketing, both at U304 S & F Condominium, 137B, Panay Avenue Street, Brgy. South Triangle, Quezon City, Philippines.

Shipping

Currently, we sell and ship our products through this webpage only to locations in the Philippines.

Please note, during the current COVID19 pandemic lockdown started in March 2020, our shipping options are limited. Please see product descriptions for further details.

Taxes

earAccess® Philippines Inc. is located in the Philippines. The prices in our web shop do include the local VAT.

Indemnification

Customer shall protect, defend, indemnify and hold harmless earAccess® Inc., its distributors, its shareholders, directors, officers, employees and agents from any fines, damages, costs, losses, liabilities, fees, penalties, claims and expenses (including legal fees and expenses) incurred by earAccess as a result of the failure of the Customer or its agents, officers, directors or employees to comply with this Section.

Payment Plan

We offer until further notice the option to pay hearing aids in installments. For details about the plan, please refer to the product pages and to the following documents:

We will ask for a proof of identity (ID, proof of address like a electric bill or similar) to approve the payment plan purchase. We will not use this information for any other purpose then verifying the identity of the buyer.

WARRANTY, REPAIR, REPLACEMENT AND RETURNS

Fine Nutrition & Trading, the distributor of Access® hearing aids in the Philippines, warrants to the Client for a period of twelve (12) months from the date of payment of each hearing aid to replace any hearing aids returned by the end-user if the below items are fulfilled:

  1. It is demonstrated to the Company’s satisfaction that the hearing aids are defective in materials or workmanship;
  2. The warranty is being sought by the end user in the country where the device was purchased; and
  3. Warranty shall be invalidated and rendered void upon the following:
  4. Deterioration of the product due to normal fair wear and tear, including without limitation rust or stains;
  5. dysfunctional batteries (battery or chemical corrosion from using expired batteries or unspecified type of battery);
  6. Product shows evidence of; impact, shock; fire, flood, earthquake, lightning or other acts of nature; sand, liquid, or food damage; exposure to extreme thermal or environmental conditions beyond product specifications or a rapid change in such condition;
  7. Abuse, mishandling, improper operation or maintenance, accidents, improper storage, misuse or abnormal working conditions, loss/theft;
  8. Removal of the product serial number, temperaments, alteration and/or repair, parts replacement not provided or approved by the Company, dismantling of the hearing aid without the Company’s approval or by an unauthorized service center.
  9. failure to follow the Company’s instructions on operation and maintenance of the Product;

The warranty period shall not be extended beyond the original period with respect to repairs or returns carried out under the warranty.

Consumables, customized parts, and accessories of the hearing aid, such as batteries, ear molds, ear domes and similar are not covered by this warranty.

The warranty provided under this Agreement shall lapse for any Product in case the latter has been tampered with or if repair was attempted by somebody other than the Company.

No other warranties or remedies of any kind, whether statutory, written, oral, express, implied or otherwise shall apply.

TO THE MAXIMUM EXTENT ALLOWED UNDER APPLICABLE LAW, EXCEPT FOR THE EXPRESS LIMITED WARRANTIES SET FORTH ABOVE, PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” AND EARACCESS® AND ITS SUPPLIERS MAKE NO WARRANTIES UNDER THIS AGREEMENT, EXPRESS, IMPLIED, OR STATUTORY, BY OPERATION OF LAW OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR ANY IMPLIED WARRANTIES ARISING OUT OF COURSE OF PERFORMANCE, COURSE OF DEALING OR USAGE OF TRADE UNDER OR IN CONNECTION WITH THE PRODUCTS. EARACCESS® DOES NOT WARRANT THAT THE PRODUCTS AND CONTENT WILL OPERATE ERROR-FREE OR UNINTERRUPTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY EARACCESS®, ITS AGENTS OR OTHER REPRESENTATIVES OR EMPLOYEES SHALL IN ANY WAY INCREASE THE SCOPE OF EARACCESS®’ WARRANTIES UNDER THIS AGREEMENT. WITHOUT LIMITING THE GENERALITY OF THE FORGOING, EARACCESS® AND ITS SUPPLIERS DO NOT MAKE, AND EXPRESSLY DISCLAIM, ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, RELATED TO ANY THIRD PARTY INTELLECTUAL PROPERTY, TECHNOLOGY OR INFORMATION PROVIDED AS PART OF THE PRODUCT OR DOCUMENTATION.

No Liability

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, EARACCESS®, AND ITS SUPPLIERS, SHALL NOT BE LIABLE TO YOU, OR ANY THIRD PARTY, FOR ANY INDIRECT, EXEMPLARY, SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES OF ANY KIND ARISING IN ANY WAY OUT OF USE OF THE PRODUCTS, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, REVENUES OR COSTS OF REPLACEMENT GOODS, EVEN IF EARACCESS® HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING THE FAILURE OF ANY LIMITED REMEDY OF ITS ESSENTIAL PURPOSE.
